DYNOMITE FARM RELEASE OF LIABILITY

General Release of Liability

In consideration of my use of the premises of Dynomite Farm and its owners at 2331 Mattison Lane, Santa Cruz, CA 95062 (collectively “Releasee”), I for myself, my heirs, personal representative or assigns (hereinafter collectively, “Releasor,” “I” or “me”, which terms shall also nclude Releasor’s parents or guardian if Releasor is under 18 years of age or accompanying animal), do hereby release, waive, discharge, and covenant not to sue Releasee, it’s trustees, directors, officers, employees and agents from liability from any and all claims resulting in personal injury, accidents, or illnesses (including death) and property loss arising from use of premises.

Inherent Risks Visiting a working farm carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. These risks include, but are not limited to: uneven terrain, slippery surfaces, farm equipment, insects, wildlife, plants with thorns or sharp edges, exposure to sun, wind, and weather, and other natural and agricultural hazards. I know, understand, and appreciate these and other risks are inherent in the activity I am participating in. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification I also agree to indemnify and hold harmless Releasee, its trustees, directors, officers, employees and agents from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees as a result of this use of premises.

Severability I further expressly agree that the foregoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Minors If I am the parent or guardian of a minor or minors visiting the farm, I understand that I am responsible for their supervision and safety at all times. This waiver extends to and covers all minors under my care during my visit. I represent that I have the legal authority to bind such minors to this waiver.

Animals Any animals brought onto the property must remain under my control at all times. I am solely responsible for any injury, damage, or loss caused by animals under my control. I release Releasee from any liability arising from the presence or actions of my animals on the property.

Personal Property I am responsible for the security of my personal belongings. Dynomite Farm is not responsible for lost, stolen, or damaged personal items.

Photography Dynomite Farm may take photographs or video during my visit for promotional purposes. By visiting, I grant Dynomite Farm permission to use such images unless I notify Dynomite Farm otherwise in writing prior to my visit.

Agreement I have read this waiver of liability, assumption of risk, and indemnity agreement, and fully understand its terms. I acknowledge that I am agreeing to this agreement freely and voluntarily and intend by purchase of any product or reservation at Dynomite Farm to be a complete and unconditional release of all liability to the greatest extent allowed by law. By checking the box at checkout, I confirm that I have read, understood, and agree to this Liability Waiver on behalf of myself, any minors accompanying me, and any animals under my control.
